Copyright up, even if YouTube still only pays crumbs

"Despite their growth, these figures are still far from the level they should reach.The major sectors that exploit creative content devalue our work," said Jean-Michel Jarre, President of CISAC, quoted in a statement. According to the French pioneer of electronic music, "the 'transfer of value' is a perfect illustration of this phenomenon in the digital market, where platforms such as YouTube only give away crumbs to authors".
YouTube, a free platform owned by Google, claims a billion users, while Spotify, the world's leading paid streaming, claims to have 60 million paid subscribers (and 140 million free users).

"At the moment, asking governments for a solution to the transfer of value is a top priority," concludes Jean-Michel Jarre.

Jean-Michel Jarre leads call for European Parliament to “shape a fairer digital market”

As all the copyright directive chitter chatter continues in Brussels, musicians Jean-Michel Jarre and Angelique Kidjo have both put their names to an open letter to the European Parliament urging MEPs to back safe harbour reform.

The draft copyright directive spent all of last year working its way through the motions with a flurry of amendments being proposed. There are various articles in the directive of relevance to the music community, though it is the clause that seeks to reform the safe harbour that has got the most attention. This, of course, seeks to increase the liabilities of user-upload websites like YouTube, mainly to strengthen the negotiating hand of music rights owners so to force up the royalties the Google video sites pays.

While all that has been going on, YouTube has entered into new licensing deals with the majors, and on the back of that some record label execs seem to be warming to the big bad Google business once again. Though that didn’t stop a stack of music industry trade bodies signing a recent letter to the new EU presidency, urging it to back safe harbour reform as the copyright directive reaches its final stages.

Jarre and Kidjo have now written to the European Parliament in their guise as President and Vice-President of CISAC, the global grouping that brings together all the song right repping performing rights organisations around the world. The CISAC membership also includes some collecting societies representing other creative sectors, so this week’s letter was also signed by visual artist Miquel Barcelo and film directors Marcelo Pineyro and Jia Zhang-ke, who are all also VPs of CISAC.

In their letter to all those MEPs, they write: “The proposals by the European Commission, currently being discussed in the European Parliament, are among the most important copyright reforms of the last 20 years in Europe. They are a first step in the right direction, offering a historic opportunity to bring fairer remuneration for creators and drive economic growth and jobs in the creative industries”.

Honing in on safe harbour reform and the music industry’s ‘value gap’ campaign, the letter goes on: “In particular, Europe now has a chance to address the ‘transfer of value’ or ‘value gap’ which is caused by loopholes in the law allowing some of the world’s largest digital platforms to deny fair remuneration to millions of creators. To do this effectively, it is essential for the legislation to ensure fair remuneration by user uploaded content platforms such as YouTube. EU law should not be a shield to allow such platforms to make vast revenues from creative works while not fairly rewarding the creators”.

Noting that CISAC – as a global organisation – is hoping Europe can lead on all this, they add: “The proposed copyright reform puts Europe in a unique position of international leadership. As creators representing regions around the world – Africa, Asia, North and South America and Europe – we are watching events in Brussels with great hope. We know that our governments are also monitoring the situation very closely and may follow up with similar laws”.

In conclusion, Jarre et al state: “Thousands of artists and authors within Europe have already voiced their solidarity with the European Commission’s proposals. We now send our own message of encouragement to take this legislation to its full potential. Members of Parliament, we ask you to take this opportunity to shape a fairer digital market for creators in the 21st century”.

Jean-Michel Jarre urges European Parliament to close loopholes in copyright law

The current proposals have been called "the most important copyright reforms of the last 20 years in Europe."

Jean-Michel Jarre has signed an open letter to European Parliament backing amendments to copyright law.

Jarre is the president of CISAC, an international conglomerate of performing rights organisations aiming to close copyright loopholes in a directive currently being drafted by the European Parliament. The aim is to strengthen the position of copyright holders negotiating licensing deals with large-scale digital platforms like YouTube and Spotify. The current law allows streaming services to pay lower royalties in the EU than other territories, which the CISAC has called "a major problem... holding back our sector and jeopardising future sustainability."

The open letter deems the current proposals "the most important copyright reforms of the last 20 years in Europe." The letter continues: "Europe now has a chance to address the 'transfer of value' or 'value gap' which is caused by loopholes in the law allowing some of the world's largest digital platforms to deny fair remuneration to millions of creators. Letter from Jean-Michel Jarre on the defense of authors' rights

We are writing as creators from around the world - and the President and Vice-Presidents of CISAC - to ask for your support for authors in the current discussions on the copyright package which, if properly approved, will put Europe as a world leader in justice for authors in the digital world. CISAC - International Confederation of Societies of Authors and Composers - represents more than 4 million creators of music, audiovisual, theater, literature and visual arts in 121 countries.

The proposals of the European Commission, currently under discussion in the European Parliament, are among the most important copyright reforms of the last 20 years in Europe. They represent a first step in the right direction, providing a historic opportunity to award fairer compensation to creators and boost economic growth and employment in the creative industries. In particular, Europe now has the opportunity to address "value transfer" or "value difference" caused by loopholes in the law, allowing some of the world's largest digital platforms to deny fair compensation to millions of creators.

To achieve this effectively, it is essential that legislation ensures fair remuneration supported by user-uploaded content platforms (UUCs) such as YouTube. European legislation should not act as a shield that allows such platforms to earn large revenues at the expense of creative work, not just rewarding creators.

The proposed copyright reform puts Europe in a unique position of international leadership. As creators representing the various regions of the world - Africa, Asia, North and South America and Europe - we see the events in Brussels with great hope. We know that our governments are also following the situation very closely and can come up with similar legislation.

Thousands of artists and authors in Europe have already expressed their solidarity with the proposals of the European Commission. We thus send our own message of encouragement to ensure that this legislation reaches its full potential.

Members of Parliament, we ask you to seize this opportunity to shape a fairer digital market for creators in the 21st century.

CISAC joins rights holders in Bulgaria as it takes on European Union Presidency

CISAC, MUSICAUTOR, FILMAUTOR, GESAC and SAA convene with Bulgaria on EU copyright reform and national issues

Drawing attention to the importance of this moment to Bulgarian audiences, CISAC President Jean-Michel Jarre and Director General Gadi Oron, along with Musicautor CEO Ivan Dimitrov were interviewed for The Day Starts with Culture on Bulgarian National Television, as part of the television station and Musicautor’s “The Price of Creativity” campaign.

In the interview, Jean-Michel Jarre drew attention to Europe’s central role in protecting authors, notably in today’s environment:

“Europe has always been a champion in protecting authors’ rights. Since the 18th century, there has been a thinking, particularly in France with Beaumarchais, about the idea of droit d’auteur. Authors are now at the centre of a huge industry, which represents more revenue than automobile or luxury industries, that employ millions of people around the world, yet which has never been so fragile economically.”

Bulgaria has unique opportunity on the world stage to improve the situation of creators in the European Union and subsequently throughout the world. Jean-Michel Jarre drew attention to this during the interview, stating:

“We are expecting from Brussels a legal framework to protect creators. I believe that Bulgaria has a role to play. It is an important part of Europe. We have a common cultural past. The voice of Bulgaria is extremely important for all of us, not only for Europeans but for all artists-African and developing country artists who are expecting a lot from Europe. The eyes of all creators, everyone who is interested in the future of creativity, are watching Bulgaria and Europe.”

Jean-Michel Jarre and an authors' delegation call on the European Parliament for fair rules in the digital world

Authors worldwide look for Europe’s leadership to address the “transfer of value”

Brussels, Belgium - 6th March 2018 – World-renowned electronic music composer and performer Jean-Michel Jarre led a delegation of authors(*) in Brussels today to call for support by members of the European Parliament to bring fairness for authors in the digital world.

Jarre and the delegation from 5 different Member States presented a petition signed by more than 14,000 authors and composers from across the EU. The petition calls for an end to the “transfer of value” that is benefiting certain major digital platforms at the expense of creators.

Jarre was speaking as President of CISAC (the International Confederation of Societies of Authors and Composers) which is the voice globally of over 4 million creators of music, cinema, visual arts, theatre and literature. The delegation was jointly coordinated by GESAC, which represents one million authors from all sectors in Europe.

The authors expressed their full support for the European Commission’s proposed Copyright Directive, currently pending before the Parliament, and urged the JURI Committee of the European Parliament to stick firm on a real and meaningful solution on transfer of value, and not to deviate from this line.

The group also thanked a growing number of Member States in the Council, including France, which are committed to effectively addressing the “transfer of value” or “value gap” in the proposed Copyright Directive that is currently under discussion in the European Parliament.

Jean-Michel Jarre said: “Celebrating and promoting creativity has always been a part of Europe’s DNA. But today, in Europe and worldwide, creators are seeing the value of their work being unfairly extracted by digital platforms. The world is now watching the EU. It is for Europe to prove that it remains the champion of culture. We need a 21st century copyright framework for a 21st century digital market – one that allows future generations of creators to be fairly remunerated and be able to make a living from their work.”

The music sector and other creative sectors are growing fast and generating vast revenues, but these revenues are not fairly returned to the creators. Instead they are being siphoned off by large global digital services – notably user upload platforms such as YouTube – which refuse to share their vast revenues with those who created the content uploaded to their services.

The creators’ petition asks EU policy makers to fix this transfer of value in the proposed copyright legislation.

“EP Pervenche Berès, co-chair of the Cultural and Creative Industry Intergroup (CCI) said: “Europe should adopt an ambitious solution to stop this totally unfair situation of free riders in the market and ensure a strong and sustainable ecosystem. Creators’ engagement by our side is extremely valuable for us and for the cause we defend because the stakes are high and because some MEPs in this house do unfortunately listen to and believe these giants.”

MEP Christian Ehler, co-chair of the CCI said: “Europe has an historical opportunity today to address the issue, which is about the future of cultural and creative industries and also about the digital single market at large. It’s about European economy and growth. It’s also about culture which is what keeps us together. This is a decisive period, where the EU has a chance to put forward a meaningful solution.”
